Terms of Service

1. Introduction
These Terms of Service govern your use of Caylaconnect (the "Service"), operated by Studio Quarante 5 Nord, registered in Bordeaux, France ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Acceptance of Terms
By creating an account, subscribing, or otherwise using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.
3. Description of Service
Caylaconnect provides personalised menopause support tools, including symptom and cycle tracking, journaling, a library of yoga, breathwork and meditation content, community features, courses, and optional 1:1 coaching sessions with qualified coaches.
4. Account and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account. You must provide accurate and complete information when creating your account and keep it up to date.
5. Acceptable Use
You agree not to misuse the Service. Prohibited activities include, but are not limited to: unlawful use; fraud or spam; infringement of intellectual property rights; interference with the security or integrity of the Service (including malware, probing, scraping, or attempting to circumvent technical limits); harassment or abuse of other users or coaches; and sharing content that is illegal, harmful, or violates the rights of others.
6. Intellectual Property
All content, software, documentation, branding, and other materials provided through the Service are owned by Studio Quarante 5 Nord or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your personal use within your selected plan. You may not reverse engineer, resell, redistribute, or otherwise exploit the Service except as expressly permitted.
7. Cancellations
You may cancel a booked coaching session from your account at any time. Coaches may also decline or cancel sessions; in such cases you will be notified through the Service.
9. Service Level
We aim to provide a reliable and high-quality Service, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and "as available". We disclaim all implied warranties, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
10. Limitation of Liability
To the extent permitted by law, our aggregate liability is limited to the total fees you paid to us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where required by law.
11. Termination and Suspension
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ceases immediately. You may export your data prior to termination where the Service permits.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bordeaux, France.
